9 June 2011 – Andrew Benson at the Governance, Risk and Compliance Congress
Andrew Benson spoke in Brighton at the Governance, Risk and Compliance Congress on 9 June 2011 as regards his views on the implementation of the Bribery Act due to come in to force on 1 July 2011. Andrew expressed reservations as regards the resources being devoted to the enforcement of this legislation and questioned the true motivation behind the widespread publicity from the Serious Fraud Office concerning ‘self reporting’ from corporate entities. Andrew also commented on recent rulings from the senior judiciary as regards to whether it is proper, or lawful, for prosecutors and defendants to present ‘plea agreements’ to the Courts restricting a Judge’s ability to impose the sentence that he or she feels appropriate for the particular level of offending disclosed.
