Customs act unlawfully on refusing repayment of duty
The firm acted successfully on behalf of its client Europlus Trading Limited in an action against HM Revenue and Customs. Europlus exported duty paid goods to Europe and sought to recover that duty. HMRC unilaterally, as the First Tier Tax Tribunal has found, changed is policy under the duty draw back regime infringing both Europlus’ European Community rights and the Company’s Human Rights. Accordingly HMRC has been ordered to pay the company’s claims in full together with its legal costs. Full details are available from Andrew Benson.
